MINUTES OF THE MEETING HELD ON 6 FEBRUARY 2004

THE PAVILION, PAKENHAM AT 7.30 PM

PRESENT: Cllr J Mangnall, Cllr D Dorling, Cllr H Painter, Cllr R Griffin, Cllr P Smith, Mr RJ Butler, Mr J Harris, Mrs A Harris, Mr P Goldsworthy, Mrs P Ashman, Mr P Harris, Mr C Baker and Mrs J Brookman (Clerk).

APOLOGIES: Cllr J Speare, Cllr L Couper, Cllr V White and Cllr C Spicer.

1.0 - DECLARATION OF INTERESTS:
Prior to the meeting Cllr Painter declared an interest in planning application no. SE/04/1016/P Manor Farm, Upper Town, Pakenham and was not present until shown in the minutes.

2.0 - PUBLIC FORUM:
Village residents commented on the proposed revised scheme for the erection of a dwelling and garage at Manor Farm, Upper Town, Pakenham following confirmation from the Borough Council that an application made and approved in 1985 was considered "alive".

The Chairman convened the meeting.

3.0 - PLANNING APPLICATIONS:

NEW APPLICATIONS:

SE/04/1016/P Manor Farm, Upper Town, Pakenham
Erection of dwelling and garage (revised scheme).

The Parish Council objected to the above application on the following grounds. In a letter from Abbotts (2/10/89) the Planning Officer was notified of the applicants wish to relocate the position of the approved access and in their letter of 22 November 1989 it was confirmed that the proposed development had been constructed. The Planning Officer confirmed in letter dated 8 January 1990 to Abbotts that the site had been inspected and that access to the site had been constructed and this constituted a "specified operation" thereby keeping the 1985 application "alive". Local knowledge would dispute that the access was moved and would confirm that the current access is the original access to the meadow. Inspection at the present time will show a gateway into a meadow devoid of any signs of construction of a residential access. The Parish Council is of the opinion that the revised scheme is irrelevant on the grounds that the 1985 application has lapsed. The Parish Council is aware the above is totally contrary to the letter of 8 January 1990 issued by the Planning Officer responsible at the time, and therefore requests that a thorough investigation of all the facts is carried out. If it is accepted that work was commenced and the original application is valid then it would like to also make the following points:- It would create a precedence for building outside the settlement boundary of the village; it is noted that in the original consent certain conditions would have to be met and would like confirmation that points 2, 6 and 8 have been complied with, if not the application will be void; on visiting the site it can be appreciated that the original cottages nestled into their surroundings in the lowest area of the meadow. The proposed new dwelling will "sit" on a much higher site well above the road level and will not be in keeping with the other dwellings or the location. Clerk to write to Mr JR Massey, Director of Planning as above points and ask that the committee refuse the application.

Erection of two storey rear extension

The Parish Council considered that the proposed extension would have a serious effect on the adjoining property and that a two-storey extension of this mass should have a pitched roof. The proposed extension would be clearly visible from Thieves Lane and would look unattractive.

Fell ten Conifer trees situated within a Conservation Area.

Parish Council recommended that if permission is granted then replacement trees of an indigenous species should be substituted as the property is within the conservation area of the village.

SE/04/1223/P Red Castle Farm, Brand Road, Great Barton
Erection of building for the storage of straw and machinery

No objections to this application.

4.0 - CLERK'S REPORT:
Following a request for a sand bin in the St Mary's View area of the village the cost per bin would be approximately £57 plus VAT. Clerk to make enquiries as to Parish Council's liability.

5.0 - DATE OF NEXT MEETING:
The next meeting will be held on Monday, 23 February 2004 in the Village Hall commencing at 7.30 pm.
